Your Tier II Reporting Is Due March 1

EPCRA is an important law that dramatically affects almost all facilities that manufacture, use, or store numerous hazardous chemicals. Most states require the Tier II form for all facilities required to report.

Section 311 requires facilities that are required to prepare MSDSs/SDSs under OSHA regulations to submit either copies of their MSDSs/SDSs or a list of MSDS/SDSs chemicals to the Local Emergency Planning Committees, the state agency, and the local fire department.

Section 312 requires facilities to submit a Tier II form for facilities that meet the following criteria:

  1. Required under OSHA’s Hazard Communication Standard to prepare or have available an MSDS/SDS, and
  2. Had hazardous or extremely hazardous substances at or above threshold levels present at the facility at any time during the previous calendar year.

The Tier II information must be submitted for covered facilities on or before March 1 annually.
