The EPA has finalized the Definition of Solid Waste (DSW) rule.

The rule, which modifies the 2008 rule, requires offsite recycling at a facility with a RCRA permit or verified recycler variance, affirms the legitimacy of the pre-2008 DSW exclusions, revises a definition of legitimate recycling, and includes a targeted manufacturing exclusion for certain higher value hazardous spent solvents.

The EPA has released a pre-publication version of the final rule.
