Top 10 reasons for construction stormwater fines

According to Jennifer Hildebrand, Environmental Compliance Manager at WSB and Associates, Inc., and one of the workshop presenters at this year’s StormCon conference in Myrtle Beach, SC, there are many reasons fines may be levied against developers for their stormwater management –or lack thereof –at construction sites.

Hildebrand offered what can be considered the top reasons fines are levied for stormwater mismanagement at construction sites:

  1. Improper implementation of or lack of best management practices (BMPs)  for erosion and sediment control and stormwater management
  2. Incomplete or lack of a stormwater pollution prevention plan (SWPPP)
  3. Incomplete or lack of documentation of required inspections
  4. Insufficient implementation of the SWPPP as described
  5. Incomplete or lack of BMPs
  6. Improper installation of BMPs
  7. Public complaints
  8. Continued discharges after warnings and citations
  9. Lack of proper response after a discharge
  10. Failure to submit a Notice of Intent for stormwater permit coverage before construction begins

Enforcement and inspections are on the rise nationwide under municipal, state, and federal regulatory programs. Be sure you are taking care of business at your construction site and don’t get fined for any of these reasons.
